These Terms of Use (the "Terms") govern your access to and use of the website https://poston.ai/ and any related products, applications, APIs, dashboards, and services (collectively, the "Service") operated by Poston.ai ("Poston", "we", "us", or "our"). By accessing the Service, joining the waitlist, creating an account, or otherwise using any feature of the Service, you ("you" or the "User") agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. About the Service
Poston.ai is an AI-powered platform that helps users plan, generate, schedule, publish, and analyze content on LinkedIn, including organic posts, carousels, and paid advertising campaigns. The Service may evolve over time, and we may add, modify, or remove features at our discretion.
The Service is currently in pre-launch / waitlist mode. Access to certain features may be limited, gated, or offered on an invitation-only basis.
2. Eligibility & Accounts
- You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) to use the Service.
- You must have the legal authority to enter into these Terms, either on your own behalf or on behalf of the organization you represent.
- You are responsible for the accuracy of the information you provide (including your name, email, company, and LinkedIn page URL).
- You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- You must notify us promptly of any unauthorized access to or use of your account.
3. LinkedIn Integration & Compliance
The Service connects to LinkedIn (a service of LinkedIn Corporation) through LinkedIn's official APIs and OAuth authentication. By connecting your personal LinkedIn account or an organization / company page, you acknowledge and agree to the following:
- You are solely responsible for ensuring that you have the right to connect the LinkedIn account or page in question, including any necessary authorization from the organization that owns the page.
- Your use of LinkedIn through the Service is also governed by the LinkedIn User Agreement, the LinkedIn Professional Community Policies, the LinkedIn Privacy Policy, and, where applicable, the LinkedIn Ads Policies and the LinkedIn API Terms of Use. You agree to comply with all of these at all times.
- You must not use the Service to violate LinkedIn's policies, including (without limitation) prohibitions on spam, scraping, fake engagement, automation that mimics human behavior in a deceptive way, harassment, hate speech, misleading advertising, or any other prohibited activity.
- You authorize Poston, acting as your agent and on your behalf, to access, read, create, schedule, publish, edit, and delete content on the LinkedIn account(s) and page(s) you connect, and to create, manage, and report on LinkedIn advertising campaigns, in each case strictly within the scope of the permissions you grant.
- You can revoke this authorization at any time by disconnecting your account in the Service or in your LinkedIn settings. Revocation does not retroactively affect actions already performed.
- LinkedIn may, at its sole discretion, restrict, suspend, or terminate access to its APIs, change rate limits, or modify available features. Poston is not liable for any disruption, downtime, or limitation that results from such changes.
- Poston is not affiliated with, endorsed by, or sponsored by LinkedIn Corporation. "LinkedIn" is a trademark of LinkedIn Corporation; we use it only to describe interoperability.
4. AI-Generated Content
The Service uses artificial intelligence and large language models, in some cases provided by third parties, to generate text, carousels, ad copy, captions, audience suggestions, and other outputs ("AI Output"). You acknowledge that:
- AI Output is generated probabilistically and may contain errors, omissions, biases, or content that is misleading, inaccurate, or inappropriate.
- You are solely responsible for reviewing, editing, fact-checking, and approving any AI Output before publishing it on LinkedIn or anywhere else.
- You must not rely on AI Output for legal, medical, financial, or other professional advice.
- Where required by applicable law or by LinkedIn (for example, in regulated advertising contexts), you must clearly disclose that content was generated or assisted by AI.
- Identical or similar AI Output may be generated for other users; we make no claim of exclusivity over AI Output.
5. Acceptable Use
You agree not to use the Service to, and not to allow any third party to:
- Violate any applicable law, regulation, or third-party right (including intellectual property, privacy, and personality rights);
- Generate, schedule, or publish content that is unlawful, defamatory, harassing, threatening, hateful, sexually explicit, violent, or otherwise objectionable;
- Impersonate any person or entity, or misrepresent your affiliation with a person, organization, or company;
- Engage in spam, mass unsolicited messaging, fake reviews, artificial engagement, follower-buying, or any deceptive marketing practice;
- Run advertising campaigns that promote illegal goods or services, or that violate LinkedIn's advertising policies;
- Reverse engineer, decompile, scrape, or attempt to extract the source code or training data of the Service, except to the extent permitted by mandatory law;
- Interfere with, disrupt, or place excessive load on the Service or its infrastructure;
- Use the Service to build or train a competing AI model or competing publishing product;
- Resell, sublicense, or commercially redistribute the Service without our prior written consent (resale to your own end-clients within an "agency" plan is permitted within the limits of that plan).
6. User Content
"User Content" means any content you submit to the Service, including prompts, drafts, brand voice samples, uploads, brand assets, audience descriptions, and any content you publish through the Service to LinkedIn or other platforms.
You retain all rights you have in your User Content. You grant Poston a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, transform, and display User Content solely for the purpose of operating, securing, and improving the Service and providing it to you. We will not sell your User Content.
Unless you opt out (where opt-out is available), we may use de-identified, aggregated, or anonymized signals derived from User Content to improve the Service. We will not use the substantive text of your User Content to train third-party foundation models without your consent.
You represent and warrant that you own or have all necessary rights to your User Content and that its use through the Service does not infringe any third-party right.
7. Intellectual Property
The Service, including all software, design, branding, the "Poston.ai" name and logo, and the underlying technology, is owned by Poston or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service.
As between you and Poston, and to the maximum extent permitted by law, you own the AI Output you generate through the Service, subject to: (i) the rights of any underlying model providers; (ii) the requirement that similar outputs may be generated for other users; and (iii) the limitation that you must not claim copyright over outputs in a manner inconsistent with applicable law.
8. Plans, Billing & Waitlist
- Waitlist. Joining the waitlist does not create a paid contract. It only allows us to contact you about early access. You may unsubscribe at any time.
- Free plan. The Starter plan, when available, is offered free of charge but with limited features and quotas. We may modify those limits at any time.
- Paid plans. Pricing for the Pro and Agency plans will be communicated at launch. Paid plans are billed in advance on a recurring basis (monthly or annual). All fees are non-refundable except where required by mandatory law.
- Taxes. Fees are exclusive of applicable taxes (VAT, sales tax, withholding tax, etc.), which are your responsibility unless we are legally required to collect them.
- Cancellation. You may cancel a paid plan at any time; cancellation takes effect at the end of the current billing period.
9. Third-Party Services
The Service relies on third-party providers, including (without limitation) LinkedIn, AI model providers, payment processors, email providers, and cloud hosting providers. Your use of those services through Poston is also governed by their respective terms. We are not responsible for the content, availability, accuracy, or practices of third-party services.
10. Privacy & Data
Our processing of personal data is described in our Privacy Policy. By using the Service, you confirm that you have read and understood that policy. When you connect a LinkedIn account or page, we process the data made available through LinkedIn's APIs strictly to provide the Service to you.
11. Suspension & Termination
- You may stop using the Service at any time and may delete your account through the in-product settings (when available) or by contacting us.
- We may suspend or terminate your access immediately, without notice, if we reasonably believe that you have violated these Terms, that your use poses a security or legal risk, or that LinkedIn has required us to do so.
- On termination, your right to use the Service ends. Provisions that by their nature should survive (including IP, disclaimers, liability limits, indemnities, and governing law) will survive.
12. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, or freedom from defects. We do not warrant that the Service will achieve any specific marketing, growth, engagement, or advertising result.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Poston, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, audience, or reputation, arising out of or in connection with the Service, even if advised of the possibility of such damages.
Our aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the amount you paid to Poston in the twelve (12) months preceding the event giving rise to liability, or (b) one hundred euros (EUR 100). Some jurisdictions do not allow certain limitations; in such jurisdictions, our liability is limited to the smallest extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Poston and its affiliates from and against any claim, damage, liability, loss, or expense (including reasonable attorneys' fees) arising out of: (i) your User Content; (ii) your use of the Service; (iii) your violation of these Terms; (iv) your violation of any third-party right, including LinkedIn's terms or any intellectual property, privacy, or publicity right; or (v) content you publish on LinkedIn or elsewhere through the Service.
15. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using the Service.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of France, without regard to conflict-of-law rules. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France, except where mandatory consumer law gives you the right to bring proceedings in the courts of your place of residence. Before initiating formal proceedings, the parties agree to attempt in good faith to resolve any dispute by contacting hello@poston.ai.
